What Type of Estate Plan is Right for You?

A distinct aspect of estate planning is ensuring that your assets transfer to the individuals you choose in the manner that you wish. There are many tools that you can utilize in transferring your estate to family and friends, such as:

  • Last will and testament: a simple will can be an effective tool to tell your loved ones exactly how to you wish to pass inheritance once you have passed on. In the creation of a will, you can designate trusts to be created, guardianships over minor children, and how other essential legal matters should be handled. However, life sustaining wishes should be addressed in other forms of estate planning.
  • Revocable trusts: a revocable trust, also called a living trust, is a trust that is created while you are living for the benefit of you and your family. Living trusts are often used to avoid probate. Rather than passing assets through estate administration, the assets simply remain in the trust for the benefit of the remaining beneficiaries.
  • Irrevocable trusts: an irrevocable trust, also known as a living trust, transfers your assets while you are living -- with the inability to revoke the transfer -- in order to minimize estate taxes.
  • Other trusts: Depending on your individual situation, we can help you create other important trusts, such as a life insurance trust, a special needs trust, a charitable remainder trust, a marital deduction trust, or other forms of trusts.
